Application of Terms and Conditions

These terms and conditions apply to all contracts between you and Balloons For U Ltd, 149C Pack Lane, Kempshott, Basingstoke, Hampshire, RG22 5HN.

Interpretation

"We", "us, "our", means Balloons For U Ltd
"You", "your" means the person ordering products or services under these terms and conditions.
"Working days" means all days other than Saturdays, Sundays, and Public Holidays.
"Product" means the product or products you have ordered from us.

Product Availability

It is possible that in some instances product may be unavailable, in which case we will endeavour to provide equivalent alternatives to the same or higher value. We will make every reasonable effort to inform you of this by either telephone or e-mail.

The delivery times given are approximate and delays can sometimes occur. You will receive an e-mail as soon as your order is dispatched. All delivery times quoted on this website are estimates only. These times are based on working days.

You will become the owner of the products you have ordered when the products have been dispatched to you with proof of postage.

Price & Postage

Prices shown on this website include VAT, where and to the extent that VAT is required to be applied to the product under UK VAT law. Delivery charges are detailed when you proceed to check-out.

Confirming the Order

In placing this order you confirm that you are aware of any age restrictions on these products and assert that you are old enough to purchase them. Please note that all orders are made subject to these Terms and Conditions of Supply.

The Contract Between Us

Contracts formed between Balloons For U Ltd and users as a result of using this site shall be governed in all respects by English law and all such users hereby submit to the non-exclusive jurisdiction of the English courts. Completion of the contract between you and us will take place on dispatch to you of the products ordered. This will be deemed to be our acceptance of your offer and to have been effectively communicated to you. This is to be interpreted and enforced with the laws of England, in its entirety and will be subject to the jurisdiction of the English courts.

Restrictions

You must be aged 18 years or over to place an order. Details of any delivery restrictions are noted in the details/description for the products concerned. In some instances we may decline to deliver parcels to PO Box addresses. We will contact you if we consider the PO Box address to be a problem.

Payment Details

We accept payment by Visa, MasterCard, Switch, Maestro and Delta. All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion. We do not receive details of your card which are automatically processed by STREAMLINE. If any refund becomes due to you we will contact you for your card details.

Your Cancellation Rights

If you wish to cancel an order you must contact Balloons For U Ltd directly on 01256 819200. Cancellation before dispatch will not incur a cancellation fee, but cancelled returned orders accepted back by Balloons For U Ltd will be subject to a 25% re-stocking fee. Dispatched orders will only qualify for cancellation if you have contacted Balloons For U Ltd AND they are returned, at your expense, with the transit packaging unopened and the goods contained within are in a saleable condition.

Price Changes

Balloons For U Ltd reserve the right to change prices listed without notice. All orders for products are subject to availability and Balloons For U Ltd reserves the right to refuse to supply to any individual or company.

Pricing Errors

Although we make every effort to ensure the prices on the website are correct, mistakes may sometimes be made. If we discover a mistake in the price of the products you have ordered, we will tell you and give you the option of either reconfirming your order at the correct price or cancelling your order. If we are unable to contact you or we receive no reply from you, we will cancel your order. If your order is cancelled you will receive a full refund.

Severability

If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

Governing Law

These terms and conditions and any contract between us shall be governed by and interpreted in accordance with English Law and the English Courts shall have jurisdiction over any disputes between us

Statutory Rights

These terms and conditions are in addition to your statutory rights as a consumer, which remain unaffected.

Seller Liability

The seller does not accept liability for shortages in quantities delivered unless the buyer notifies the seller of any claim of short delivery of the goods within one working day of delivery. In such circumstances the seller's liability shall be restricted to making good the shortfall.

Returns of Faulty Goods

We visually inspect all products before they are dispatched so the occurrence of faulty goods will be small to non-existent. Balloons For U Ltd does not give refunds on unwanted goods and will only accept the return of faulty goods. You should inform us by telephone, fax or e-mail within 1 working day of receipt if you believe you have received faulty products. Faulty products returned without this prior notice will not be accepted for refund. Faulty products may be returned:

In person to Balloons For U Ltd. At the time of return you must show your invoice as proof that you purchased the products from us.

By post. Repackage the products securely and send the products together with the reason for return, the invoice number, your e-mail address or telephone number. Returns by post are made at your risk. We recommend that you use an insured registered mail service as returns not received by us cannot be credited to you. Your return delivery charges will be refunded by us if the return is made in accordance with the conditions mentioned above. Refunds will be credited to your payment card. Refunds will not be paid in cash.

Returned goods will be inspected on receipt and obviously mis-treated/used items will not be accepted for refund. In the event of rejection for refund the goods will be retained for 14 days for your collection after which they will be destroyed.

Goods 'Lost In Transit'

We only accept orders for delivery to UK addresses. Please allow 7 working days from the date of despatch before reporting the goods as lost in transit. If this time elapses and the goods have not arrived, you should contact us on 01256 819200.

Damage in Transit

You should report damage in transit direct to the carrier of the goods within the carrier's guidelines. You should also report the fact to Balloons For U Ltd by telephone, fax or e-mail within 24 hours of receipt.
